Agreement to Terms

By accessing and using the services of Yard Solutions Landscaping ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

Services

Yard Solutions Landscaping provides professional landscaping services including, but not limited to, landscape design, installation, irrigation systems, and yard maintenance in the Utah Valley area.

Estimates and Quotes

All estimates and quotes provided are:

• Valid for 30 days from the date of issue unless otherwise specified
• Based on the information provided and site conditions at the time of assessment
• Subject to change if project scope or site conditions change
• Not binding until a written contract is signed by both parties

Payment Terms

Payment terms are as follows:

• A deposit may be required before work begins (typically 25-50% of the total project cost)
• Final payment is due upon completion of work unless other arrangements are made in writing
• We accept cash, check, and major credit cards
• Late payments may incur a fee of 1.5% per month (18% APR)

Cancellation and Rescheduling

Cancellation and rescheduling policies:

• Cancellations must be made at least 48 hours in advance
• Cancellations with less than 48 hours notice may forfeit the deposit
• Rescheduling requests should be made as early as possible
• Weather-related cancellations will be rescheduled at no additional cost

Client Responsibilities

The client agrees to:

• Provide accurate information about the property and project requirements
• Ensure access to the work site during scheduled service times
• Mark or identify underground utilities, sprinkler systems, or other hidden obstacles
• Remove or secure pets during service
• Notify us of any concerns or issues in a timely manner
• Maintain installed landscaping according to our care instructions

Warranties

We warrant that:

• All work will be performed in a professional and workmanlike manner
• Plant materials are guaranteed for 30 days from installation (subject to proper care and watering)
• Hardscape installations are warranted for one year against defects in workmanship
• Warranties are void if the client fails to follow maintenance instructions
• Warranties do not cover damage from acts of nature, neglect, or misuse

Limitation of Liability

To the fullest extent permitted by law, Yard Solutions Landscaping shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the total amount paid for the services in question.

Property Damage

While we take every precaution to protect your property, we are not responsible for damage to unmarked underground utilities, sprinkler systems, or other hidden obstacles. We carry general liability insurance but encourage clients to mark all known underground features.

Changes to Work

Any changes to the agreed-upon scope of work must be requested in writing and may result in additional charges. We reserve the right to refuse requests for changes that compromise the quality or integrity of the project.

Weather and Force Majeure

We are not liable for delays or failure to perform due to weather conditions, natural disasters, or other events beyond our reasonable control. We will make reasonable efforts to reschedule services as soon as possible.

Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Utah County, Utah, in accordance with the rules of the American Arbitration Association.

Intellectual Property

All landscape designs, plans, and related materials created by Yard Solutions Landscaping remain our intellectual property unless explicitly transferred in writing. We reserve the right to photograph completed projects for marketing purposes unless the client objects in writing.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
